Pedestrian dies after being struck by alleged drunk driver

A 43-year-old California pedestrian was pronounced dead after he was struck by a pickup truck. According to the report, the auto-pedestrian accident occurred after the driver of the truck failed to follow a curve in the roadway. The truck went onto the sidewalk and hit the pedestrian. The 19-year-old driver was taken into police custody and was charged with vehicular manslaughter and felony DUI. No other information on the pedestrian has been released, and the investigation is still in progress.

Because pedestrians are not protected from vehicles, serious injuries and death can occur if a pedestrian is hit by a vehicle. If the pedestrian does survive, they may suffer from broken bones, internal injuries, abrasions and brain trauma, among other serious injuries. Victims that become injured due to a driver's negligence may be entitled to compensation in order to cover medical bills, lost wages and pain and suffering, in addition to funeral expenses if the victim dies.

An experienced California attorney may be able to help the victim or the victim's family obtain compensation. The attorney may first prove who was liable for the accident by investigating the cause. In this case, for example, the driver was accused of drunk driving, which caused them to miss the curve in the road. Therefore, the driver may be held responsible for the pedestrian's death.

In many cases, the insurance agency may attempt to settle with the victim quickly in order to pay them less in compensation. The attorney may be able to negotiate a larger settlement by proving the extent of the victim's injuries and the expected recovery time. If the pedestrian is permanently injured, the accused driver may also be responsible for the victim's extended care needs.
